  • The User Content is accurate and lawful.

We reserve the right to remove User Content at our discretion.

  • Videos
  • Software
  • Website design
  • Text
  • Product documentation

is owned by or licensed to the Company and is protected by U.S. and international intellectual property laws.

No content may be copied, reproduced, distributed, displayed, modified, or otherwise used without prior written permission.

 

11. RCA Trademark Notice

RCA® and the RCA logo are trademarks used under license.

Nothing contained in the Services grants any right, title, or interest in any RCA trademark, logo, trade name, or other intellectual property except as expressly permitted by law.

 

12. Third-Party Websites

The Services may contain links to third-party websites, retailers, payment providers, or service providers.

We do not control and are not responsible for:

  • Products
  • Services
  • Privacy practices
  • Business practices

Your use of third-party websites is at your own risk.

 

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, PRODUCTS, CONTENT, AND INFORMATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

 

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • USE OF THE SERVICES
  • PURCHASE OF PRODUCTS
  • LOSS OF PROFITS
  • LOSS OF DATA
  • LOSS OF BUSINESS OPPORTUNITIES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

(A) $100 USD; OR

(B) THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT.

 

15. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors, and service providers from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of any applicable law.
  • Your infringement of any third-party rights.

 

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.

Before filing any legal claim, you agree to first contact us and attempt to resolve the dispute informally.

Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.

We may modify these Terms at any time.

Updated Terms will be posted on the Services with a revised effective date.

Your continued use of the Services following the posting of revised Terms constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
